PRIVACY STATEMENT PARKLING

This is the privacy statement (“Privacy Statement”) of Parkling GmbH (“Parkling”). In this Privacy Statement, we explain how Parkling, as a controller, processes the personal data obtained in the course of its relevant activities, i.e. generating parking and parking availability data in respect of a specific region, and how Parkling complies with data protection laws in this regard.

1. Does this Privacy Statement apply to you?

This Privacy Statement applies to you if you have been in the vicinity of a scancar or inventory scanner of Parkling while it is in operation. The Parkling scancars can be recognized by a parking scanner installed on the back of the car, a white GPS antenna installed on the roof of the car and signs saying “Parkling Scancar” installed on both front doors of the car. The Parkling inventory scanner can be recognized by a grey box with a camera and a black GPS antenna on the roof of a car. The scancars as well the inventory scanners are used by Parkling in the course of its services to generate - non personal - information on the availability of parking space in a specific region.

2. Parkling Service - Personal Data

To generate the information on the actual availability of parking space in a region, Parkling may process a limited amount of personal data. Below, we explain how the Parkling service works, and what kind of personal data is processed in this respect.

The Parkling Service
The Parkling service consists of generating and providing information on the actual availability of parking space for a specific location. In order to be able to generate such (real time) information, as a first step Parkling has to map the relevant static parking data, i.e. all parking spaces and the applicable parking rules, for the region concerned. For that purpose, Parkling makes use of scancars that are equipped with video equipment. The scancars are driving around in the region concerned. By recording the surroundings, the camera’s in the scancars take inventory of all parking spaces and applicable parking rules for that region.

Processing of Personal Data
When the scancar records its surroundings, the recording may include images that allow for direct or indirect identification of a natural person. Therefore, these images may qualify as personal data within the meaning of the General Data Protection Regulation (“Personal Data”). Such images are:

  • recording of persons that happen to be in the recording radius;

  • recording of license plates of cars that happen to be in the recording radius;

  • recording of houses and house numbers in the recording radius.

Parkling processes this Personal Data on the basis of its legitimate interest to generate the information on the actual availability of parking space in a region and to be able to provide such information to its business partners. Please note that Parkling does not provide your Personal Data to its business partners or any other third party, but only general aggregated parking and parking prediction data. 3. What measures does Parkling take to protect your Personal Data?

Once recorded, the images are automatically encrypted real-time in the scancar or the scanner with state of the art encryption technology. Upon completion of the recording of the relevant area, the data recorded by the scancar or scanner is decrypted and immediately and automatically blurred. The blurring technology makes all captured images that contain Personal Data unrecognisable, which process is irreversible. After the blurring technology is applied the original video and Personal Data included therein cannot be restored. The foregoing ensures that the original images including Personal Data cannot be reconstructed.

4. How long does Parkling retain Personal Data?

As indicated above, the data is encrypted in-car or on the scanner and will be decrypted and immediately blurred as soon as possible after completion of the recording of the relevant area. Hence, Parkling does not retain the Personal Data. It is immediately deleted after applying the blurring technology.

5. What rights can you exercise in relation to your Personal Data?

Following the General Data Protection Regulation, you have the following rights in relation to your Personal Data to the extent (still) processed by Parkling:

  • Right of access. You have the right to receive a copy of your Personal Data.

  • Right to rectification. You have the right to have incorrect Personal Data corrected.

  • Right to erasure. Under certain conditions, you have the right to have your Personal Data erased.

  • Right to restriction of processing. Under certain conditions, you have the right to request Parkling to restrict the processing of your Personal Data.

  • Right to data portability. Under certain conditions, you have the right to receive your Personal Data, and/or have it transmitted to a third party.

  • Right to object. Under certain conditions, you have the right to object to the processing of your Personal Data.

Please note that we may be required to establish your identity before we can respond to your request.
